Buyer
The Buyer is any party entering into a contract with Amplivox Limited for the purchase of Goods.
Amplivox Warranty
Our products are supplied with a three-year warranty as standard on parts and labour. For all claims, the carriage to and return from our premises is at the risk and expense of the Buyer. Pricing
Invoices will be at the prices in our latest written quotation. Where no quotation is issued the Goods will be invoiced at the prices in our price list applicable at the time of dispatch.
Payment Terms
Except where our quotation offers different terms, payment in full (including any taxes) is due within 30 days from date of invoice and payments are deemed received by us upon receipt of cleared funds into our bank account.
Title
The property in and title to the Goods shall remain vested in Amplivox Limited and shall not pass to the Buyer until payment in full is received in accordance with our Payment Terms and no other sums whatever are due from the Buyer to Amplivox Limited; Where payment in full is not received in accordance with the our Payment Terms then we shall have authority to retake, sell or otherwise deal with and / or dispose of all or any part of the Goods and to enable us to repossess the Goods our agents and employees shall be entitled at any time and without the need to give notice to enter upon any property upon which the Goods or any part are stored, or upon which we reasonably believe them to be kept; Until the property in and title to the Goods shall pass from Amplivox Limited to the Buyer in accordance with the conditions stated above, the Buyer will remain liable in full to Amplivox Limited for any loss or damage to the Goods howsoever such damage is caused and it shall be the duty of the Buyer to insure the Goods at their full market value and the Buyer shall store or mark the Goods in a manner reasonably satisfactory to us indicating that title to the Goods remains vested in Amplivox Limited; Notwithstanding that the title to and property in the Goods has not passed to the Buyer, the Buyer shall be entitled to sell the Goods or any part thereof, but such sale shall be deemed to be solely for the account of Amplivox Limited and any proceeds thereof shall be held by the Buyer on behalf of Amplivox Limited until the Buyer has paid Amplivox Limited the price in full.
Liability
Irrespective of whether title to the Goods remains vested in Amplivox Limited, risk in the Goods shall pass to the Buyer upon delivery.
Cancellation
Except where our quotation excludes cancellation, the Buyer may cancel an order prior to despatched by notifying us by email to sales@amplivox.com stating the order details including the buyer’s reference, organisation name and address and the item(s) and that the Buyer wishes to cancel. There is no fee for this service.
Returns
The Buyer may return unused Goods in the original cartons for a refund by notifying us within 7 days of delivery by email to sales@amplivox.com stating the order details including the Buyer’s reference, organisation name and address and the item(s) and that the Buyer wishes to return the Goods. There is a 20% re-stocking fee for this service. The return carriage is at the Buyer’s risk and the costs of returning and insuring the Goods in transit to Amplivox Limited shall be borne by the Buyer. We will examine the Goods to determine (at our sole discretion) that the Goods are complete with all accessories and documentation and in an unused condition. Where the returned Goods meet these criteria we will make a refund less the fee.
